A procedural hearing was held in the Letcher County Circuit Court on Tuesday, the 28th of June, in order to determine whether the case against Childers Oil could be considered as a class action, as opposed to having 80 separate plaintiffs. Based on the ruling on Tuesday, it appears that the case will be moving forward as a class action, a ruling which allows for the lawsuit to become less complex and it will speed up the case considerably.
